9-AI LLC (“9AI,” “we,” “us,” or “our”) operates the website at https://9ai.co and develops software that integrates with third-party platforms, including the Meta Platform (Meta Ads API), Google Ads, Google Analytics, and other marketing and CRM technologies. This Privacy Policy explains how we collect, use, disclose, and safeguard information when you visit our website or use our services. By accessing or using our services, you agree to the terms of this Privacy Policy.

1. Scope of This Policy

This Privacy Policy applies to: all visitors and users of https://9ai.co; Client organizations and their authorized representatives who access our software products and services; any application operated by 9AI that connects to third-party platforms (including Meta, Google, and CRM systems) on behalf of Clients; and any AI-powered features, agents, or automated workflows provided as part of our services. This policy does not apply to third-party websites or platforms we do not own or control, including Meta’s own platforms or Google’s services.

2. Information We Collect

2.1 Contact & Account Information

Name, email address, company name, job title, phone number, and other details you voluntarily provide when registering for an account, contacting us, or using our services.

2.2 Usage & Technical Data

IP addresses, browser type and version, operating system, pages visited, time spent on pages, referring URLs, and device information collected automatically when you visit our site via cookies and similar technologies.

2.3 Third-Party Platform Data

When a Client authorizes our application through Meta, Google, or other supported platforms, we may receive access tokens and advertising campaign data (e.g., ad performance metrics, account identifiers, campaign names, budget data, and audience insights) solely on behalf of and at the direction of that Client. We do not access platform data on behalf of individual consumers. All third-party platform data is accessed exclusively through Client authorization for the purpose of delivering our B2B services.

2.4 CRM & Communication Data

Records of correspondence, support tickets, communications between you and 9AI, and CRM data synchronized from Client-authorized systems (such as contact records, pipeline information, and interaction history).

2.5 AI Interaction Data

When you interact with our AI-powered features (including AI agents, automated outreach tools, and content generation systems), we may collect prompts, inputs, outputs, usage patterns, and feedback to provide and improve the service. AI interaction data associated with a Client account is treated as Client data and subject to the same protections described in this policy.

2.6 Voice & Call Data

If you interact with our AI voice agents or telephony features, we may collect call recordings, transcripts, call metadata (duration, timestamps, phone numbers), and AI agent conversation logs. Call recording is conducted in compliance with applicable consent laws, and participants are notified at the start of any recorded call.

2.7 Billing & Transaction Data

If applicable, payment-related information processed through our third-party payment processors. We do not store full credit card numbers or payment credentials directly.

3. How We Use Your Information

We use the information we collect to: provide, operate, maintain, and improve our services; power AI-driven features including automated outreach, content generation, and intelligent campaign management; respond to inquiries and support requests; send transactional and administrative communications; authenticate users and maintain account security; analyze usage trends and service performance; comply with legal and contractual obligations; fulfill our obligations under third-party platform frameworks (including Meta and Google); detect and prevent fraud or security incidents; train and improve our AI models using aggregated and anonymized data; and enforce our Terms of Service. We will not use your information for any purpose incompatible with those described here without your prior consent.

4. AI & Automated Processing

9AI employs artificial intelligence and automated decision-making as core components of our service offerings. This section describes how these technologies are used and your rights in relation to them.

4.1 AI-Powered Features

Our platform uses AI to power features including but not limited to: automated outreach and appointment setting via AI voice agents and messaging; content generation and campaign optimization; lead scoring and prioritization; CRM data enrichment and analysis; and personalized recommendations and insights. These features process Client data to deliver the authorized services.

4.2 Human Oversight

All AI-generated content, communications, and recommendations are subject to Client review and approval workflows before external distribution. Clients retain full control over which AI features are enabled and how automated outputs are used.

4.3 Automated Decision-Making (GDPR Article 22)

Where our services involve automated decision-making that produces legal or similarly significant effects, we ensure that: meaningful human oversight is maintained; you have the right to obtain human intervention; you can express your point of view and contest any automated decision; and clear explanations of the logic involved are available upon request. 4.4 AI Data Handling

Client data processed by our AI systems is: used only to provide the specific services authorized by the Client; not shared with other Clients or used to train models for other Clients without explicit consent; subject to the same retention and deletion policies as all other Client data; and protected by the same technical and organizational security measures described in Section 10.

5. Third-Party Platform Data — Tech Provider Obligations

9AI LLC builds and maintains developer applications that access third-party platforms — including the Meta Ads API and Google Ads API — on behalf of our Client organizations, operating in the capacity of a technology provider under each platform’s respective framework.

5.1 Meta Platform Data

Our access to and use of Meta Platform data is governed by Meta’s Platform Terms and Developer Policies. We access Meta Platform data only to provide the specific services our Clients have authorized. We do not sell, rent, license, or transfer Meta Platform data to any third party; use it for advertising targeting or profiling unrelated to the authorized service; or use it for any purpose beyond what is explicitly authorized by the Client and permitted under Meta’s Platform Terms.

5.2 Google Platform Data

Our use of Google APIs (including Google Ads API and Google Analytics) complies with the Google API Services User Data Policy. We access Google data only to provide authorized services and do not use it for purposes unrelated to the Client’s authorized service scope.

5.3 Authorized Access Only

Our applications access third-party accounts and advertising data exclusively through properly authorized connections — including OAuth tokens, System User tokens, and Business Manager access — granted by the Client. We do not access any accounts or data without explicit Client authorization.

5.4 Client Responsibility

Clients who authorize our application are responsible for ensuring their use complies with applicable laws and each platform’s terms of service; maintaining their own privacy policies where required; and ensuring they have appropriate authority before granting our application access to third-party assets.

5.5 Compliance

Our applications, data practices, and developer operations comply with the terms and policies of each platform we integrate with. We participate in required platform reviews and audits as applicable.

5.6 Data Deletion Requests

In compliance with platform terms, 9AI supports data deletion requests. If a Client or authorized user submits a data deletion request — or if a platform issues a Data Deletion Callback — we will process the deletion of associated platform data within 30 days. 6. Data Sharing and Disclosure

We do not sell your personal information. We may share information only in the following circumstances: with Service Providers (third-party vendors assisting in operating our platform, subject to confidentiality obligations and data processing agreements); with Clients (data belonging to a Client’s authorized account); with AI Sub-processors (third-party AI model providers used to deliver AI-powered features, subject to strict data processing agreements that prohibit training on Client data); for Legal Compliance (when required by law, regulation, court order, or governmental authority); for Protection of Rights (when necessary to protect the rights, property, or safety of 9AI or our users); in Business Transfers (in connection with a merger, acquisition, or asset sale); or With Your Consent.

7. Data Retention

We retain personal information only as long as necessary to fulfill the purposes for which it was collected, comply with legal and regulatory obligations, and resolve disputes. Third-party platform data accessed via APIs is retained only for the duration required to deliver the authorized service. AI interaction data (prompts, outputs, logs) is retained for the duration of the Client relationship plus 30 days unless a shorter retention period is requested. Call recordings and transcripts are retained for 90 days by default, or as configured by the Client. Upon termination of a Client relationship, we delete or anonymize their associated data within 30 days. Account information and business records may be retained for up to 7 years as required by applicable financial and legal record-keeping obligations.

8. Your Privacy Rights

Depending on your location, you may have the right to: access or receive a copy of your personal data; request correction of inaccurate data; request deletion of your personal data; object to or restrict certain processing activities; receive your data in a structured, machine-readable format (data portability); and opt out of automated decision-making and profiling.

8.1 California Residents (CCPA/CPRA)

California residents have additional rights under CCPA/CPRA, including: the right to know what personal information is collected, used, shared, or sold; the right to delete personal information; the right to opt out of the sale or sharing of personal information (we do not sell personal information); the right to limit the use of sensitive personal information; and the right to non-discrimination for exercising these rights. 8.2 EEA, United Kingdom & Switzerland (GDPR / UK GDPR)

If you are located in the EEA, UK, or Switzerland, you have rights under GDPR or equivalent legislation. Our legal bases for processing include: contract performance; legitimate interests (analytics, security, fraud prevention, and service improvement); legal obligation; and consent. You also have the right to lodge a complaint with your local data protection authority (DPA).

8.3 Exercising Your Rights

To exercise any of your rights, please contact us at privacy@9ai.co. We will respond within the timeframes required by applicable law (generally 30–45 days). We may need to verify your identity before processing certain requests.

9. International Data Transfers

9AI LLC is headquartered in the United States. If you are accessing our services from outside the United States — including from the EEA, UK, or other regions — your information may be transferred to, stored, and processed in the United States. For transfers from the EEA or UK, we rely on appropriate safeguards including Standard Contractual Clauses (SCCs), UK International Data Transfer Agreements (IDTAs), and adequacy decisions where applicable. Our AI sub-processors are subject to the same transfer safeguards.

10. Cookies and Tracking Technologies

We may use cookies, web beacons, and similar tracking technologies to analyze site traffic, maintain session state, and improve user experience. Types include: Strictly Necessary Cookies (required for core functionality); Analytics Cookies (to understand how visitors use our site, including Google Analytics); and Preference Cookies (to remember your settings). You can control cookie preferences through your browser settings. We do not currently use Meta Pixel or other Meta tracking tools on our website.

10.1 Do Not Track

Some browsers offer a “Do Not Track” (DNT) signal. There is currently no universally accepted standard for how companies should respond to DNT signals. We do not currently respond to DNT signals, but we do not engage in cross-site tracking of our users.

11. Data Security

We implement industry-standard technical and organizational measures to protect your information, including: encryption in transit (TLS) and at rest; access controls and role-based permissions; row-level security on all multi-tenant data; regular security assessments and penetration testing; incident response procedures; and secure AI model integration with encrypted API communications. In the event of a data breach affecting your personal information, we will notify affected individuals and relevant authorities as required by law (within 72 hours for GDPR-covered incidents). No method of transmission over the internet is 100% secure, and we cannot guarantee absolute security.

12. Children’s Privacy

Our services are not directed to individuals under the age of 13 (or 16 in the EEA/UK where applicable), and we do not knowingly collect personal information from children. Our AI features are not designed for or directed at minors. If you believe we have inadvertently collected information from a child under the applicable age threshold, please contact us immediately at privacy@9ai.co and we will promptly delete such information.

13. Third-Party Links and Services

Our website or services may contain links to third-party websites, integrations, or services — including Meta’s platforms, Google services, CRM systems, and telephony providers — that are not owned or controlled by 9AI. This Privacy Policy applies only to 9AI’s own services. We encourage you to review the privacy policies of any third-party services you access through our platform.

14. Changes to This Policy

We may update this Privacy Policy from time to time. When we do, we will revise the “Last Updated” date at the top of this page. For material changes, we will notify you by email or through a prominent notice on our website prior to the change becoming effective. Your continued use of our services after any changes constitutes your acceptance of the updated policy.
